Patent Coordination Unit

The job description of the Patent Coordination Unit, which will continue its activities under the ADA Coordinators of İzmir Bakırçay University, can be characterised as assisting and supporting all our researchers in the protection of intellectual property rights and patenting of outputs such as “patent”, “design”, “utility model” developed as a result of scientific research and projects carried out by all academics, university staff, students or employees at İzmir Bakırçay University. However, the primary duties and responsibilities of the Patent Coordination Unit are summarised as follows: 

  • To organise trainings/seminars to introduce Intellectual and Industrial Property Rights to university staff and students and to raise awareness in this context. Examination of the “Invention Notification Form” and documents, if any, submitted to the Patent Coordination Unit by the University staff.
  • An eligible invention for a patent that meets the patentability criteria is submitted to the Intellectual Property Evaluation Board (IPEB) by making a preliminary evaluation.
  • To follow the process of the patent application file.

İzmir Bakırçay University ADA patent application processes proceed in the following order:

  • The process starts when the inventors submit the Invention Notification Form to the Patent Coordination Unit in writing and electronically. The Patent Coordination Unit examines the form and other information and documents related to the invention, if any.
  • In cases where an invention is deemed eligible for patent protection, the Patent Coordination Unit thoroughly examines all relevant documents to determine whether the necessary patentability criteria are met.
  • The preliminary evaluation of the application is made and sent to the Patent Attorney with whom an attorney agreement has been made for applications that do not require correction/amendment, and a Preliminary Technology Assessment Report is prepared.
  • The Preliminary Technology Assessment Report is submitted to the Intellectual Property Evaluation Board (IPEB).
  • IPEB requests the Technology Preliminary Assessment Form to be updated/re-prepared when necessary.
  • After evaluating the commercialisation potential and the preliminary research report, the IPEB decides whether the invention is a ‘service invention’ or ‘free invention’.
  • IPEB submits its opinions on Intellectual and Industrial Rights applications to the Rector for approval and notifies the Patent Coordination Unit of its decisions.
  • The Patent Coordination Unit notifies the inventor in writing of the decisions of the IPEB.
  • All rights of the inventor are protected during the application process. The Patent Coordination Unit follows the process, and İzmir Bakırçay University covers all necessary expenses.
  • In the case of commercialisation of the invention, the income obtained is shared after deducting all expenses, including taxes.

The distribution of possible revenues for inventions at the commercialisation stage is shown in Table 1, and the workflow of the patent application process is summarised as follows:

Stages and time frames from the patent application process to the decision process in Turkey

The national legislation adopted by the Patent Coordination Unit, which will continue its activities under the ADA Coordination Unit:

  • Regulation on Inventions of Employees, Inventions Realised in Higher Education Institutions and Inventions Arising in Public Supported Projects
    • Industrial Property Law No. 6769
  • Regulation on the Implementation of the Industrial Property Law.

However, the international legislation that should be adopted in the process of creating patents and intellectual property of international quality can be summarised as

  • Regulation on the Implementation in Turkey of the European Patent Convention on the Grant of European Patents
  • Patent Cooperation Treaty (PCT)
  • Patent Cooperation Treaty Regulation
  • Strasbourg Treaty on the International Classification of Patents

The performance indicators of the Patent Coordination Unit, which will continue its activities under the ADA Office, are listed below.

  • Number of Patents Obtained for Products Resulting from R&D
  • Number of Products Commercialised as a Result of R&D
  • Number of Patent, Utility Model and Industrial Design Applications
  • Number of Finalised Patents, Utility Models and Industrial Designs
  • Number of Social Responsibility Projects Carried Out by the Organisation

Under the issues specified in İzmir Bakırçay University Intellectual and Industrial Property Rights Directive, it is planned that the preparation of patents and intellectual property documents that are likely to be created as a result of the successful completion of qualified projects of academics, existing patent research and related activities will be followed by the expert(s) within the ADA Coordinators.
